What is the difference between legal rules and moral rules?

Descargar la transcripción

Our behavior in the public sphere is regulated by law. 00:00:01
Law, the legal rules, are made by the authority, and they are compulsory. 00:00:06
This means that these rules are external. 00:00:13
They are not made by you or by me. 00:00:16
They are not made by the individual who must obey them. 00:00:19
They are made by someone or something superior. 00:00:23
the state, the city, the government, the principal of a school, that's why we say that the law is 00:00:26
external. We also say that the law is compulsory because we must follow the rules, the legal norms, 00:00:36
because if we don't, we can be punished. Now, it's important that you understand the difference 00:00:44
between legal rules and moral rules. Morality is also made by norms, but they are different. 00:00:51
They are not made by external authorities. They are made by yourself. Your morality is made by 00:00:58
your own moral conscience. Morality is formed by rules that tell you what is right and what is 00:01:06
wrong, and it is your conscience that tells you what is correct or incorrect. If you don't obey 00:01:14
your own moral rules, nobody will punish you, but you will feel bad. You will feel guilty. You will 00:01:22
feel what we call remorse. Imagine, for example, that you lie to a friend. He's a very good friend 00:01:30
of yours and you tell him a lie if you do that maybe he will never discover and he will never 00:01:40
punish you for that but you won't feel okay you will feel remorse because you broke one of your 00:01:48
personal moral rules which is being sincere with a loyal friend in the public sphere we have then 00:01:56
the law, the legal rules, and also each person has their own moral rules. This means that sometimes 00:02:05
there can be conflicts between morality and legality. Sometimes the law permits things 00:02:13
that some people consider immoral. That's what happens, for example, with abortion. Abortion is 00:02:21
permitted in Spain in certain cases, but some people consider that it shouldn't because it is 00:02:28
immoral. Now, sometimes the situation is the opposite. Sometimes the law forbids things that 00:02:34
people consider morally correct. For example, some people think that it should be permitted 00:02:42
that you can vote when you're 16, but the law forbids this because the legal age to vote is 18. 00:02:48
Now, what should we do when there is a conflict between the law and morality? There is a dispute 00:02:57
here some people think that the law should always be obeyed because if we break the law whenever we 00:03:03
think it is not correct life together in society would be impossible but other people disagree 00:03:10
other people think that law is only fair and acceptable when it respects morality so whenever 00:03:19
a law breaks basic moral rules, it shouldn't be followed and we should try to resist it 00:03:28
and to change it because it is unjust. 00:03:36
